Many of the tires included in this sale are new but were manufactured over five (5) years ago; which is beyond the manufacturers recommended tire installation age and contradicts certain laws binding the sale of NEWLY manufactured tires. All new tires in this section, due to the reasons above, are being sold as used tires and are sold under the used tire disclaimer outlined below. All used tires are sold "as-is where-is." Due to many varied and different conditions to which used-tires may have previously been exposed; Jackson’s Service Center makes absolutely no warranty, expressed or implied, as to the fitness for a general or particular purpose or of merchantability in connection with any sale of used tires. All used tires are sold "as is." Used tires are not tested or labeled by Jackson’s Service Center to meet any safety standards. The purchaser of used tires from Jackson’s Service Center agrees to accept all risks relating to the use of such used tires.

 

Limitation and Disclaimer of Remedy: under no circumstances shall Jackson’s Service Center, its officers, directors, agents or employees be held liable to any party for loss of profit, indirect, incidental, punitive, special, consequential, exemplary, injury or similar damages of any kind whatsoever for any action based on usage of used tires.

 

Buyer accepts and acknowledges the risk of repair and replacement in purchasing or using any used product may under some circumstances (whether such circumstances are foreseeable or not) be or become impossible, and buyer agrees and acknowledges that such impossibility of repair or replacement will under no circumstances give rise to any substitute or alternative remedy other than liquidated damages in an amount equal to the purchase price paid for such irreplaceable or irreparable product.

 

Limitation of damages: buyer and Jackson’s Service Center stipulate, acknowledge and agree that in no event and under no circumstances, including but not limited to a determination that any or all of this agreement is unenforceable for any reason, will Jackson’s Service Center incur liability to buyer or any third party in an amount in excess of the lesser of (a) the price originally paid by the buyer to Jackson’s Service Center for the used product, or (b) an amount in excess of the cost of labor/ installation.

* Mount & Balance fees may vary depending on the type of vehicle and size of tire in question. Mount & Balance implies mounting of the tire onto "usable" rim/wheel in decent operational shape, balancing implies balancing of a mounted tire on a computerized balancing machine.

² Studdable tire pricing of $17.50/tire applies to tires purchased from Jackson's Service Center. Pricing may differ on tires purchased elsewhere. Studs can only be inserted into new tires that have never been run on a vehicle and have not driven on the road. Other terms and restrictions may apply.
